Managing Director gets formal caution
23 November 2006
Jamie Hodgskins, 22, of Cadishead, Manchester today pleaded guilty at Wigan Magistrates Court for fly tipping waste consisting of bin bags and cardboard boxes at Salford Anglers Club, Astley Moss, Wigan on 5 June 2006. The waste was from his place of employment. Hodgskins and a colleague had been instructed to take the waste to a tip but chose instead to dump it in the Wigan Borough.
He was fined £200 and ordered to pay £560 towards costs which were made up of £410 investigation costs and £150 legal costs. A total of £760. He was given credit for his early guilty plea. He was, however, warned that he was facing a custodial sentence and a driving ban for the offence.
His co-defendant, asked for his case to be adjourned as he was unable to attend. He will appear on 7 December 2006. Both defendants were in company with each other and both admitted illegal disposal of controlled waste on land where no licence was in force contrary to Section 33 (1) of the Environmental Protection Act 1990.
The Managing Director of the Warrington company who employed them has already been given a Formal Caution for a Duty of Care offence in connection with this case.
