Over the past 5 years the issue of fly tipping has grown considerably. Historically, the Environment Agency looked after the issue but the truth of the matter has always been that local authorities have quietly handled the majority of incidents.
This does not show itself on the database run by the Agency.
As more and more economic drivers make the disposal of waste, especially commercial waste, more expensive, fly tipping has become a risk worth taking for many. Increased legal powers have been given to local authorities to prosecute fly tippers along with people who drop litter or allow their dog to foul designated areas.
A new Memorandum of Understanding has been drawn up between the Environment Agency and Local Authorities putting the ball squarely in the Local Authorities court as far as fly tipping is concerned.
This programme has been devised to assist the Local Authorities in moving towards rigorous enforcement of the new powers they now have. It is also tasked with the education and training of Magistrates in the consequences of enviro crime. It is currently (until December 2004) funded by the Environment Agency NW and managed by the Lancashire Business Environment Association on their behalf.
More cases will be brought to Court. More cases will end in severe financial penalties, some cases will result in imprisonment. Fly tipping is anti-social behaviour and should be punished accordingly.
